European Court of Human Rights | Third Party Intervention

A/Prof. Ayelet Berman, Dr. Marija Jovanovic (Essex), and Mayer Brown LLP (Singapore/New York) were granted leave by the European Court of Human Rights to submit a Third Party intervention in the case of Vesna Pešić and Others v Serbia (Application Nos. 48973/20, 54565/20, and 54676/20). This case challenges restrictions on the freedom of movement imposed on older persons during the COVID-19 pandemic. The submission briefs the ECHR regarding emerging principles and practices governing restrictions on the freedom of movement of older people during public health emergencies. The Brief reviews guidance and recommendations from international, regional, and civil society organizations. It also reviews the practices of a hundred states regarding restrictions on movement during the pandemic.
